Respondents Mr. M.K. Khuntia, A.G.A. for the State
CORAM:
THE CHIEF JUSTICE JUSTICE M.S. RAMAN Order No.
ORDER
21.11.2022 03.
I.A. No.334 of 2019 and W.A. No.61 of 2019
1. There is delay of 860 days in filing the present writ appeal. The reason given in the application for delay is only that the previous counsel could not inform the Appellant of the outcome of the writ petition. The Court does not find the explanation to be convincing. It was for the Appellant to follow up on the writ petition and ascertain its outcome in good time.
2. Consequently, the Court is not satisfied that there is any reasonable explanation for the inordinate delay in filing the writ appeal. Accordingly, the I.A. for condonation of delay is dismissed. Consequently, the writ appeal is dismissed. (Dr. S. Muralidhar) Chief Justice (M.S. Raman) Judge S.K. Guin
