Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 08.02.2022 in connection with Cuttack Sadar P.S. Case No.455 of 2021 corresponding to G.R. Case No.1864 of 2021 pending in the Court of learned J.M.F.C.(R), Cuttack for the alleged commission of offence under Sections 420/272/273/34 of IPC read with Sections 52/53/56/57/59/63 of Food Safety and Standard Act, 2006 and Section 16 of Prevention of Food Adulteration Act, 1954 and Section 32 of Legal Metrology (Package and Communities Rules, 20211.

Considering the submissions, materials on record and in particular the chemical examination report enclosed to the bail application issued by the Deputy Director-cum- Food Analyst of the State Food Testing Laboratory, which does not

indicate that the seized product was in any manner noxious or unfit for human consumption, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
