Heard the submission of Mr. Mohanty, learned counsel for the Petitioner.

Undisputedly the CMP involves the rejection of a Review Petition after disposal of First Appeal. For the opinion of this Court, once the Review Petition involving a First Appeal is disposed of with an order, such order merges with the First Appeal. There cannot be any independent challenge to such order. Petitioner seeks liberty of withdrawing the CMP to avail any other remedy available to them. 3.

Thus, the CMP stands withdrawn but however, with liberty as prayed for.
