Considering the submission made by the learned counsel for Petitioner, this Court directs, if there is no initiation of encroachment proceeding involving the Petitioner as yet and the application of the Petitioner at page 20 of the brief is still pending, the same shall be considered and disposed of following due process of law under the O.P.L.E Act, within a period of two months from the date of communication of an authenticated copy of this order by the Petitioner. It is further directed that in the event the Petitioner has not been evicted from the disputed property in question as yet, let there be no eviction of the Petitioner from the disputed property in question till a decision on the application of the Petitioner at page 20 of the brief is taken in terms of the above direction.
