04.04.2022 I.A. No.231 of 2022 & ABLAPL No.1811 of 2021 05.

This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode).

The I.A. No.231 of 2022 has been filed on behalf of the petitioner for appropriate order.

Learned counsel for the petitioner submitted that since the petitioner is at Dubai for business purpose, he could not appear before the Investigating Officer on the date fixed i.e. on 16.03.2022 pursuant to the order of this Court dated 09.03.2022.

This Court vide order dated 09.03.2022 directed

// 2 // specifically to the petitioner to appear before the Investigating Officer on 16.03.2022 at 10.30 a.m. for the purpose of interrogation and to assist in the investigation. The Investigating Officer has filed written objection wherein it is mentioned that the petitioner did not appear before him violating the order of this Court and he was also duly intimated about the order of the Court through e-mails and Speed Post.

Considering the submissions made by the learned counsel for the respective parties, I am not satisfied with the grounds taken in the interim application. Accordingly, the I.A. stands dismissed.

In view of the conduct of the petitioner in not complying the order of this Court dated 09.03.2022, the ABLAPL also stands dismissed.

The interim order dated 15.04.2021 stands vacated. A free copy of this order be handed over to the learned counsel for the State.
