This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner.

The petitioner has filed this writ petition seeking to quash the order of suspension dated 15.02.2021 issued by opposite party no.4 under Annexure-4, and to issue direction to the opposite parties to reinstate him in service forthwith will all service and financial benefits.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made application/show cause before the opposite party no.4 vide Annexure-3, and the same may be directed to be disposed of within a stipulated time taking into consideration the judgment of the apex Court in the case of Ajay Kumar Choudhury v. Union of India, AIR 2015 SC 2389 within a stipulated time, to which learned State Counsel has raised no objection.

As agreed by learned counsel for the parties, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing opposite party no.4 to consider the representation/show cause filed by the petitioner under

Annexure-3 taking into consideration the judgment of the apex Court in the case of Ajay Kumar Choudhury v. Union of India, AIR 2015 SC 2389, and pass a reasoned and speaking order, as expeditiously as possible, preferably within a period of three months from the date of receipt of the certified copy of this order. Issue urgent certified copy as per rules.
