Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 20.01.2022 in connection with Garabandha P.S. Case No.36 of 2016 corresponding to S.T. Case No.17 of 2022 pending in the Court of learned Sessions Judge, Gajapati for the alleged commission of offence under Sections 302/34 of NDPS Act. 4.

Originally, the name of the petitioner did not find place in the FIR but he was charge sheeted on the basis of the statement of the co-accused persons.

It is submitted that the principal accused, namely, Jagannath Sabar has already been released on bail as per order passed by this Court in BLAPL No. 6778 of 2016. 6.

Considering the submissions, materials on record and the fact that the principal accused has already been released on bail, I am inclined to allow the prayer for bail. Let the

petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
