Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Balichandrapur P.S. Case No. 12 of 2014 corresponding to G.R. Case No. 26 of 2014 pending in the Court of learned J.M.F.C., Chandikhole for the commission of the alleged offences punishable under sections 365/379/34 of the Indian Penal Code.

In view of the available materials on record, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender and move for bail in the Court below within a period of four weeks from today, the same shall be disposed of by the learned Courts below in accordance with law expeditiously and if any coaccused has been released on bail in the meantime, the claim of parity shall be taken into account. The case diary be made available before the Court concerned for disposal of the case.
The ABLAPL stands disposed of.
