Mr.R.Rath, learned counsel for the petitioner submits that since the petitioner has not surrendered to custody and this Court has already passed order to take coercive steps against the petitioner and proceed against his surety in accordance with law by the learned Court in seisin of the case, therefore, the present bail application has become infructuous.
