Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 16.08.2021 in connection with Kharvelnagar P.S. Case No. 264 of 2021 corresponding to T.R. Case No. 360 of 2021 pending in the court of learned District & Sessions Judge, Khurdha at Bhubaneswar for the alleged commission of offence under Sections 21(c)/29 of NDPS Act.

Considering the submissions made and the fact that even as per the prosecution case nothing was seized from the possession of the petitioner and he has been implicated in the case on the basis of the statement of the co-accused persons, from whom seizure of the contraband was made, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the
condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 5.
BLAPL is accordingly disposed of.
