Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

Petitioner nos. 1 & 2- Pramod @ Rajkishore Sethy and Laxmidhar Sethy were on bail. Petitioner no.3 - Sanjaya Sethy was shown as absconder in the charge sheet, but for the default of the other petitioners as well as for the abscondance of accused Sanjaya Sethy, NBW was issued by the Court below, on the strength of which all the petitioners were arrested on 23.01.2022 and are in custody since then.

Considering the submissions, materials on record and the undertaking given by learned counsel for the petitioners that the petitioners shall regularly appear before the Court on each of posting of the case henceforth, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they

shall personally appear before the trial Court on each date of posting of the case, failing which necessary orders may be passed to take them to custody again by the Court below. 5.

BLAPL is accordingly disposed of.
