1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. S.R.Mohapatra , learned counsel for the Petitioner and Mr.S.K.Mishra, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 24th January, 2022 in connection with Mangalabag P.S.

Case No.10/2022 corresponding to G.R. Case No.60/2022 pending in the court of learned J.M.F.C. (City), Cuttack for the alleged commission of the offence under Sections 419/420/109/34 of I.P.C. read with

// 2 // Sections 22/23 of Preconception and Pre Natal Diagnostic Technique (Prohibition of Sex Selection) Act.

It is submitted by Mr. Mohapatra, learned counsel for the Petitioner, that the Petitioner is a sales representative of the Company which had sold the Ultrasound Machine to the Clinic in question and, therefore, he has absolutely no role to play whatsoever in the alleged occurrence. It is further submitted that there is no allegation against him of having committed any offence as alleged.

5. While opposing the prayer for bail, learned Addl. Standing Counsel for the State has not disputed the submission that the Petitioner is in fact a sales representative of the Company that had supplied the Ultrasound Machine.

6. Considering the submissions made, the materials on record, the period of detention already undergone and the fact that the co-accused persons have also been released on bail, I am inclined to allow the prayer for bail.

7. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

8. The BLAPL is disposed of.
