I.A. No.1432 of 2022 05.

1. Heard Mr. S. Pradhan, learned counsel for the Petitioner, who is Respondent No.4 in the appeal and also heard Mr. N. C. Mohanty, learned counsel for the Respondent No.3 and Mr. K.C. Nayak, learned counsel for the Appellant.

2. Present Petitioner, i.e. Respondent No.4 in the appeal, seeks modification of the order dated 28.11.2022 passed by this Court in the appeal with a prayer to grant right of recovery in his favour.

3. Having heard all the parties, no such ground is seen in favour of Respondent No.4 to get such right of recovery. As such, the prayer is rejected. The amount as directed by this Court in order dated 28.11.2022 shall be deposited before the learned Tribunal within a period of two months from today.

4. The I.A. is dismissed.

5. An urgent certified copy of this order be granted on proper application.
