1.This matter is taken up by hybrid mode.

2. The petitioner has filed this writ petition seeking a direction of this Court to the opposite parties to consider her case for transfer to any other School under Betnoti Block more particularly to Mantridahi Primary School, Bamada Primary School, Bhagabanpur Primary School where vacancies are available on the ground of her serious health issues.

3. Heard learned counsel for the parties.

4. Learned counsel for the petitioner submits that the petitioner is working as an Assistant Teacher in Jodia Kolhasahi Government Primary School under Bisoi Block, in the district of Mayurbhanj. Since she has undergone major surgery of her uterus tumor, she is not in a position to travel to a distance place of posting. Hence, she prays for transfer based on the Notification vide No.22167/ S & ME dated 04.10.2018 (Annexure-4).

Learned counsel for the petitioner further submits that the petitioner has filed her representation dated 08.12.2021 vide Anneuxre-3 before the District Education Officer, Mayurbhanj for consideration of her transfer to any other School under Betnoti Block more particularly Mantridahi Primary School, Bamada Primary School and Bhagabanpur Primary School where vacancies are available on account of her health problem but the same are pending till date.

Considering the limited grievance of the petitioner, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party No.3/ District Education Officer, Mayurbhanj to take a decision on the representation filed by the petitioner vide Annexure-3 and pass appropriate order in accordance with law within a period of one month from the date of production of certified copy of authenticated/certified copy of this order by the petitioner.
