This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Heard the learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with G.R. Case No.34 of 2021 arising out of Dasapalla P.S. Case No.23 of 2021 pending in the Court of learned J.M.F.C., Dasapalla for alleged commission of offences under sections 341/323/379/324/307/294/506/34 of the Indian Penal Code.
Perused the first information report annexed to the anticipatory bail application.
// 2 // Learned counsel for the State has produced the written instruction received from the Officer in-charge of Daspalla police station from which it appears that petitioner no.1 is having two criminal antecedents, both are under section 307 of the Indian Penal Code, petitioner no.2 is having four criminal antecedents, two are under section 307 of the Indian Penal Code and one under sections 399/402 of the Indian Penal Code and petitioner no.3 has got one criminal antecedent. The written instruction is taken on record.
In view of such written instruction obtained by the learned counsel for the State, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender in the Court below and move for bail before the learned Courts below within a period of four weeks from today, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law. The case records shall be made available to the Court concerned for adjudication of the bail application.
The ABLAPL is accordingly disposed of.
Interim order dated 15.03.2021 stands vacated. Urgent certified copy of this order be granted on proper application.
