Mr. B. Dash, learned Central Government Counsel states that he has instructions to appear on behalf of opposite party-Employee's Provident Fund Organization, Bhubaneswar.

Let a copy of the writ petition be served on Mr. B. Dash, learned Central Government Counsel within three days.

Heard learned counsel for the parties.

The petitioners have filed this writ petition seeking direction to the opposite party to include them in the EPF Scheme w.e.f. 11/1990 and pay their EPF benefits within a stipulated period after initiating a proceeding under Section 7-A of the Employees Provident Fund and

Miscellaneous Provisions Act, 1952 in respect of M/s. Executive Engineer, RW Division, Balangir and Executive Engineer, RW Division, Sonepur for assessment of dues w.e.f. the period 11/1990. 6.

Learned counsel for the petitioner contends that highlighting the grievances, the petitioner has made representation to the opposite party vide Annexure-5 and the same may be directed to be considered within a stipulated time, to which learned Central Government Counsel has no objection.

As agreed by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party to consider the representation filed by the petitioner vide Annexure-5 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.

Issue urgent certified copy as per rules.
