This matter is taken up through hybrid arrangement (virtual/physical) mode.

This is the successive journey of the Petitioner, who being in custody in connection with Barang P.S. Case No.51 of 2013 corresponding to S.T. Case No.144 of 2015 (G.R. Case No.766 of 2013) is facing trial for commission of the offence under section 302/120-B/34 o the IPC and section 25/27 of the Arms Act in the Court of the learned Sessions Judge, Cuttack, in filing this application under section 439 Cr.P.C. for consideration of his prayer for grant of bail in the above mentioned case. 3.

Heard.

Considering the submissions made and on going through the specific role said to have been played by this Petitioner in the incident deriving support from the statement of the witnesses as well as other materials on record; further keeping in view the surrounding circumstances, this Court is not inclined to reconsider

// 2 // the prayer for grant of bail to the Petitioner merely taking the period of detention of the Petitioner in custody as the changing circumstance.

However, keeping in view the submissions as to long detention of the Petitioner in custody as an under trial prisoner; the trial court is directed to take all such effective steps as provided in law for early conclusion of the trial in accordance with law. 4.

The BLAPL is accordingly dismissed.
