Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 21.01.2022 in connection with Industrial P.S. (NISA) Case No.11 of 2022 corresponding to G.R. Case No.41 of 2022 pending in the Court of learned J.M.F.C., Chhendipada for the alleged commission of offence under Sections 379/411/34 of IPC.

Considering the submissions, materials on record and the fact that no offence was actually committed, but the accused persons and others were only preparing to commit the same, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail. 5.

BLAPL is accordingly disposed of.
