This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with G.R. Case No.45 of 2020 arising out of Pattamundai P.S. Case No.45 of 2020 pending in the Court of learned J.M.F.C., Pattamundai for alleged commission of offence under section 363/34 of the Indian Penal Code.

Perused the F.I.R.

Learned counsel for the State submits that the victim has not yet been rescued.

The case is one under section 363 of the Indian

// 2 // Penal Code, which is bailable in nature. Therefore, the anticipatory bail application is not maintainable. Accordingly, the ABLAPL is disposed of.

Interim order dated 15.03.2021 stands vacated. Issue urgent certified copy as per Rules.
