Heard learned counsel for the petitioner and learned counsel for the State.

Instead of pressing the petition on merit, learned counsel for the petitioner submits that in the meantime, the Court below has issued a non-bailable warrant of arrest and the same is pending execution and accordingly, a direction is prayed for to be issued to the petitioner to surrender and go on bail as the accused was merely an agent of the company notwithstanding on bail by this Court's order dated 8th January, 2021 passed in BLAPL No.11627 of 2007. It is further submitted that the amount which is involved in the present case is a paltry sum. A prayer is also made that the grounds which have been raised in the present petition may be allowed to be agitated before the learned court below while seeking discharge and also submits that there has also been a compromise between the parties in the meantime.

Considering the above prayer and peculiar facts of the case, the CRLMC stands disposed of with a direction to the petitioner to surrender before the leaned S.D.J.M., Bhanjangar on or before 20th October, 2022 in G.R. Case No.553 of 2007 corresponding to Buguda P.S. Case No.216 of 2006 and in the event of surrender, he shall be released on bail subject to the conditions and this Court also grants liberty to him to raise all such grounds before the leaned court below at the time of framing of charge. 4.
