Heard Mr. S. Mohanty, learned counsel for the petitioner and Mr. J. Patnaik, learned Government Advocate.

The petitioner has filed this writ petition seeking direction to the opposite parties to declare that the award of tender in favour of opposite party no.4 on the basis Annexure-5 dated 02.11.2021 is illegal and bad in law and that the opposite party No.4 is a also a "non-responsive bidder". The petitioner further seeks to direct opposite party no.3 to settle the tender in favour of the petitioner. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made a representation to opposite party No.2 vide Annexure-7 and the same may be directed to be considered within a stipulated time, taking into consideration Annexures-4 and 6, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court,

without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party No.2 to consider the representation filed by the petitioner vide Annexure-7, taking into consideration Annexures-4 and 6, and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.
