Appellant Mr. Sidheswar Mallik, Advocate -versusState of Odisha and others ....

Respondents Mr. Debakanta Mohanty, Addl. Government Advocate

CORAM:

THE CHIEF JUSTICE JUSTICE M. S. RAMAN Order No.

ORDER

26.10.2022 06.

1. The first line of the impugned order dated 14th March, 2018 of the learned Single Judge reads "None appears for the Petitioner" and yet the last line of the impugned order reads "The writ petition is accordingly disposed of being not pressed". If indeed no one was present for the writ petitioner, the question of disposing of the writ petition as not pressed not arise.

2. In that view of the matter, the impugned order is set aside and W.P.(C) No.15611 of 2013 is restored to file of the learned Single Judge in the Roster Bench where it will be listed on 5th of January, 2023. On that date the counsel for Appellant and the counsel for the Respondent No.6 will appear. The learned Single Judge is requested to proceed with the petition on merits and dispose it of as

expeditiously as possible. It is made clear that this Court has not expressed any opinion on the merits of the case.

3. The writ appeal is accordingly disposed of. (Dr. S. Muralidhar) Chief Justice (M. S. Raman) Judge MRS/AKS
