Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

This is a successive bail application filed on the purported ground of change in circumstances. It is submitted that earlier application for bail was rejected by this Court on 06.01.2022 prior to submission of charge sheet and since in the meantime charge sheet has been submitted, the prayer for bail is renewed by citing the same as change in circumstances.

Submission of charge sheet cannot be a change in circumstance so as to warrant a different view being taken. Having considered the materials on record as appearing against the present petitioner, this Court was earlier not inclined to release him on bail. As such, the prayer for successive bail application also cannot be considered on such ground. The bail application therefore, stands rejected. It is open to the petitioner to renew his prayer after examination of some material witnesses in the case.

The bail application is rejected.
