This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Kodala P.S. Case No. 63 of 2017 corresponding to G.R. Case No. 126 of 2017 pending in the Court of learned J.M.F.C., Khallikote, Ganjam for the commission of the alleged offences punishable under sections 452/294/323/324/307/506/34 of the Indian Penal Code.

None appears for the petitioners on repeated calls.

It appears that the petitioners earlier approached this Court in ABLAPL No.5225 of 2017 which has been dismissed for non-prosecution as per order dated 26.04.2018.

Considering the nature of accusation against the petitioners, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender and move for bail in the Court below within a period of four weeks from today the same shall be disposed of by the learned Courts below in accordance with law expeditiously. The case records shall be made available to the Courts concerned for disposal of the bail application. The ABLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
