IN THE HIGH COURT OF ORISSA AT CUTTACK

BLAPL No.1355 of 2022 Ananda Ojha ....

Petitioner Mr. S.K.Padhi Advocate -versusState of Odisha ....

Opposite Party Mr. S.K.Mishra Addl. Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

10.5.2022.

06.

1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 7th June, 2021 in connection with Pipili P.S. Case No.292/2021 corresponding to G.R. Case No.412/2021 pending in the court of learned J.M.F.C., Pipili for the alleged commission of the offence under Sections 498-A/302/34 of I.P.C.

// 2 //

4. The allegation is that because of illicit relationship between the Petitioner and his sister-in-law, the deceased, who was his wife, became mentally depressed to such extent that she committed suicide by consuming poison. The viscera report produced by the learned State counsel clearly reveals that Oleander Glycosidal poison was detected in the viscera report. All these materials reveal a strong prima facie case against the Petitioner. As such, I am not inclined to allow the prayer for bail, which is therefore rejected.

5. However, it is open to the Petitioner to renew his prayer after examination of the informant and some material witnesses in the case.
