Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 16.04.2021 in connection with Narasinghpur P.S. Case No.29 of 2021 corresponding to S.T. Case No.42 of 2021 pending in the Court of learned Addl. Sessions Judge, Athagarh for the alleged commission of offence under Sections 395 of IPC read with Sections 25/27 of Arms Act.

Considering the submissions, materials on record, the period of detention already undergone and the fact that charge sheet has already been submitted in the case and in particular the statement of the victim recorded under Section 161 of Cr.P.C., I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case failing which

necessary orders may be passed to take them to custody again by the Court below. Further the petitioners no.1 & 2 shall appear before the IIC of Kandamal Sadar Police Station and petitioner no.3 shall appear before the IIC, Dasapalla Police Station once in every fortnight for a period of six months and such fact shall be certified by the concerned police officers to the Court once a month.

BLAPL is accordingly disposed of.
