Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner was earlier on bail. On the date fixed, he did not appear, for which NBW was issued against him on 02.02.2019, on the strength of which he was arrested and is in custody since 27.12.2021. It is submitted that the petitioner could not appear because of his health problem but he undertakes to appear on each date of posting of the case henceforth.

Considering the submissions as above, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
