This matter is taken up through Hybrid Arrangement (Virtual / Physical) Mode.

It is submitted by Mr. M.K. Mohapatra, learned counsel for the Appellant and Mr. Sk. Zafarulla, learned Addl. Standing Counsel that the Appellant Sk. Hyder has expired on being hit by bullet of the police when he was escaping from the custody during his transfer to another jail, and in this regard Simulia P.S. Case No.168 dated 24.07.2021 has been registered. This information is stated to have been obtained from the letter of the A.C.P.-in-charge of Sahidnagar P.S.

In view of such fact, the Appeal stands abated due to the death of the sole Appellant Sk. Hyder.
