Heard learned counsel for the petitioner and learned counsel for the State. No one is present on behalf of opposite party No.2.

Mr. Dalai, learned counsel for the petitioner submits that he has no instruction as to the present status of the case pending before the learned court below and since the interim protection is force since 2015, the same may be continued with necessary direction till such date when the petitioner to surrender. In other words, it is submitted that the petitioner should be directed to surrender before the learned S.D.J.M., Angul in G.R. Case No.235 of 2013 and he may be allowed to go on bail.

Mr. Praharaj, learned Standing Counsel submits that chargesheet has been submitted showing the petitioner as an absconder and in anticipation of the warrant of arrest against the petitioner,
interim protection has been obtained since 2015 which is still continuing. It is further submitted by Mr. Dalai that in connection with the case, an investigation was undertaken by the Crime Branch but petitioner has not been arrayed as an accused therein. Considering the above facts, Mr.Dalai submits that petitioner may be directed to surrender and released on bail which the Court is inclined to direct.

In view of the above submissions, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned S.D.J.M. Angul on or before 30th September, 2022 in G.R. Case No.235 of 2013 arising out of Samal P.S. Case No.24 of 2013 and in the event of his surrender, the court below shall release him on bail on such terms and conditions.
