On his own submission of Mr. Mishra, learned counsel for Order No.

Petitioner, the construction work involved herein is undertaken on the land presently recorded in favour of the State. It is, at this stage of the matter, Mr. Mishra, learned counsel for Petitioner brought to the notice of this Court that involving the land reduction during the consolidation proceeding, the Petitioner has already preferred revision before the competent authority pending vide Annexure-3.

Considering the submission made by the learned counsel for Petitioner and for the undisputed fact that the construction work is undertaken over a land recorded in favour of such party, this Court is unable to entertain the writ petition, however for the pendency of a representation on the selfsame issue before the Collector, Puri vide Anexure-4, this Court without expressing any opinion on the claim of the Petitioner simply directs, the representation at the instance of the Petitioner vide Annexure-4 shall be considered and disposed of by passing a lawful order thereon within a period of one month from the

// 2 // date of communication of an authenticated copy of this order by the Petitioner.

The writ petition stands disposed of.
