1. This is an Assessee is appeal against order dated 26th May, 2017 of the Income Tax Appellate Tribunal, Cuttack (ITAT) in ITA No.44/CTK/2017 for the Assessment Year 2009-10, the question sought to be urged by the Assessee for consideration is whether the ITAT was justified in upholding the fixing of the profit rate @ 7% of the turnover, whereas the Assessee was asking it to be fixed at 2 %?

2. Having heard learned counsel for the Assessee and having examined the impugned orders, this Court is not satisfied any substantial question of law rises for consideration.

3. The appeal is dismissed.
