1. The reply filed by the Opposite Party denying the claim on merits does not dispute the existence of an arbitration clause in the agreement between the parties. Consequently, leaving open all the contentions of either party to be urged before the learned Arbitrator, the Court appoints Mr. S.K. Acharya, Advocate practicing in this Court, as sole Arbitrator to conduct the arbitration proceedings and adjudicate the disputes between the parties including their claims and counter claims. The arbitration proceedings shall take place under the aegis of the High Court Arbitration Centre. A copy of this order be communicated to the learned Arbitrator as well as the Coordinator, Arbitration Centre forthwith.
