Heard Mr. K.P. Mohanty, learned counsel for the Petitioner and Mr. S.N. Mishra, learned Additional Government Advocate for Opposite Party - State.

The present application has been filed challenging the order of learned Additional Sessions Judge, Kuchinda dismissing the Revision preferred by the Petitioner against the order of Sub-Divisional Magistrate, Kuchinda in a proceeding under Section 147 of Cr.P.C. 3.

Admittedly the Opposite Parties are the owners of Plot Nos.307, 308, 299 and 311 over which the dispute is concerned. In the opinion of learned Sub-Divisional Magistrate, Kuchinda based on the report of the R.I., the Opposite Parties have cultivated chili in those plots fencing the same. The Petitioner has no right of use over those lands. This has been confirmed by the learned Additional Sessions Judge in the revision proceeding.

Having heard Mr. Mohanty, learned counsel for the Petitioner and upon perusal of the impugned orders, I do not see any merit to interfere with the same.

Accordingly, the CRLMC is dismissed.
