Heard learned counsel for the parties.

Learned counsel for the State submits that intimation of this BLAPL has been duly served on the informant-victim (O.P.No.2).

There is no appearance on behalf of the informant at the time of call.

The Petitioner is an accused in connection with Special Case No. 71 of 2019 arising out of Telkoi P.S. Case No. 96 of 2019 on the file of learned Additional Sessions Judge-cumSpecial Judge, Keonjhar registered for the alleged commission of offence under Sections 376(3)/506 of the I.P.C. read with Section 4 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judge-

cum-Special Judge, Keonjhar by order dated 02.02.2021, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement and medical examination report of the victim.

Taking into account the period of custody, this Court directs that the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter so as to ensure presence of the petitioner on each date of trial. 09.

Accordingly, the BLAPL stands disposed of.
