Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 13.10.2021 in connection with Pipili P.S. Case No.460 of 2021 corresponding to G.R. Case No.655 of 2021 pending in the Court of learned J.M.F.C., Pipili for the alleged commission of offence under Sections 498-A/307/302/34 of IPC read with Section 4 of DP Act.

Considering the submissions, materials on record, the period of detention and in particular looking at the dying declaration of the deceased, wherein she has not held anyone responsible for her death, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 5.

BLAPL is accordingly disposed of.
