Heard learned counsel for the petitioners and learned Standing Counsel for the State.

Instant petition under Section 482 Cr.P.C. is at the behest of the petitioners for quashing of cognizance order dated 1st October, 2015 under the Annexue-3 passed in connection with G.R. Case No.439 of 2015 pending in the file of learned J.M.F.C., Soro on the ground stated therein.

Learned counsel for the petitioners submits that as per his instruction received, the charges have already been framed in the present case but the trial has not yet commenced and in such view of the matter, since the prayer is for quashing of the order of cognizance dated 1st October, 2015, it has become infructuous. At this juncture, the learned counsel for the petitioners submits that
liberty may be granted to the petitioners to raise all such grounds at the time and during trial.

Consequently, the CRLMC stands disposed of with the liberty as prayed for.
