The grievance of the Petitioner is that he is a domestic consumer but due to outstanding amount of Rs.27,166/-, the distribution company has issued a disconnection notice to him. Therefore, he has prayed for a direction to the opposite parties 1 and 2 to resume the power supply immediately pending adjudication of the outstanding bill.

During the course of hearing, learned counsel for the Petitioner submits that the Petitioner is ready and willing to deposit the outstanding amount in instalments and as such it would be suffice to give a direction to the opposite parties 1 and 2 to accept Rs.10,000/- and thereafter the rest of the amount in suitable instalment within four months along with the current bill and consider the representation in that manner.

Taking note of the aforesaid facts and the circumstances, this Court disposes of the writ petition with an observation that if the Petitioner makes a representation within seven days hence expressing his intention to pay Rs.10,000/- along with other charges regarding reconnection of the power supply so also pay the rest outstanding amount in four equal instalments along with current bill thereafter, it is hope and trust that the Power Supply Company-Opposite Parties 1 and 2 shall do well to give reconnection to the Petitioner especially when he is a domestic consumer and suffering from disconnection of the power supply.

However, it is made clear that if the outstanding amount is more than what the Petitioner has submitted then it is directed that if the Petitioner deposits 40% of the outstanding amount, then the Power Supply Company-Opposite Parties 1 and 2 shall act on such representation of the Petitioner. 6.
Urgent certified copy of this order be granted on proper application.
