Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 03.07.2021 in connection with Golanthara P.S. Case No.179 of 2021 corresponding to G.R. Case No.33 of 2021 pending in the Court of learned Sessions Judge-cum-Special Judge, Ganjam, Berhampur for the alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act.

It is alleged that the petitioner was involved in transportation of contraband ganja weighing 370.560 Kg when he was apprehended by police. It is submitted by learned counsel for the petitioner that despite being in custody for more than a year, trial is yet to commence as the Court is presently functioning without presiding officer. Be that as it may, having regard to the huge quantity of contraband ganja, I am not inclined to allow the prayer for regular bail.

It is stated that the petitioner's father is ill and requires treatment at a higher facility.

Considering the above prayer, the bail application is disposed of with a direction to court in seisin over the matter to release the petitioner on interim bail for a period of two months from the date of his actual release on such terms and conditions as he may deem fit and proper to impose.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
