This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State.

The present contempt petition has been filed by the petitioner due to non-compliance of the order of this Court dated 11.11.2021 passed in W.P.(C) No.34649 of 2021. While disposing of the writ petition by order dated 11.11.2021, this Court without expressing any opinion on the merits of the case with a direction that in case the petitioner with regard to the grievance made in this petition, files a fresh comprehensive representation before the opposite party no.2 within fifteen days hence, the same shall be considered by the said authority and pass a reasoned and speaking order as expeditiously as possible preferably within a period of six weeks from the date of receipt of such representation along with the certified copy of the

Learned counsel for the State, on the other hand, files a letter No.6870/HUD dated 19.04.2022 issued by the Housing and Urban Development Department, Bhubaneswar for compliance of the order of this Court. Copy of the letter placed in Court today is accepted and be kept on record.

On perusal of the letter, it reveals that in compliance to the direction issued by this Court, Housing and Urban Development Department, Bhubaneswar has already issued a cheque bearing No.022562 dated 18.04.2022 amounting to Rs.84,900/- towards the petitioner arrear salary for the period from 01.07.2001 to 30.11.2001. 5.

Learned counsel for the petitioner submits that the petitioner already accepted the aforesaid amount in the meantime. 6.

Learned for the petitioner further submits that the opposite parties have not paid the entire arrear amount as due and admissible. He further submits that still some amount is left to be paid to the petitioner.

Considering the aforesaid submissions made, this Court is of the considered view that it is open for the petitioner to file a separate application claiming for left out benefit as due and admissible to the petitioner.

With the aforesaid observation, the CONTC petition is disposed of.

Urgent certified copy of this order be granted on proper application.
