Heard Mr. J.K. Panda, learned counsel for the Petitioner and Mr. K.K. Das, learned Additional Standing Counsel. 2.
Mr. Panda seeks withdrawal of the present application with liberty to renew his prayer before the learned Trial Court in terms of decision of this Court rendered in Ashis Ranjan Mohanty (Adv.) v. State of Odisha and Others, 2022 (I) OLR 555. 3.
The CRLMC is disposed of as withdrawn granting liberty that, in the event the Petitioner renews his prayer by filing an application before the learned trial court, i.e. Sessions Judge-cum-Special Judge, Malkangiri in Spl. G.R. Case No.22 of 2021, the same shall be considered in accordance with law including the principles decided in the case of Ashis Ranjan Mohanty (supra).

The CRLMC is accordingly disposed of.
