On oral prayer of learned counsel for the Petitioner, he is permitted to correct the description of Opposite Party No.1 in the cause title of the brief in Court.

Petitioner in this writ petition prays for early disposal of Demarcation Case No.183 of 2019 stated to be pending before Opposite Party No.2-Tahasildar, Kishorenagar in the district of Angul.

It is submitted by Mr. Karmi, learned counsel for the Petitioner that although demarcation of the land in question has already been made and Revenue Inspector, Handapa has submitted a report to Tahasildar, Kishorenagar on 16th March, 2020, but the Tahasildar has not passed any final order in the said demarcation case and the same is still pending. Hence, he prays for a direction for early disposal of the said Demarcation Case.

Mr. Mishra, learned ASC submits that since the demarcation has already been made, the Tahasildar will only
// 2 // pass a formal order on the basis of the report of the Revenue Inspector, Handapa. Hence, no further direction is required for disposal of the Demarcation Case.

Taking into consideration the submissions made by learned counsel for the parties, this Court is of the considered opinion that since the demarcation of the land in question has already been made by Revenue Inspector, Handapa and a report has already been submitted to that effect to the Tahasildar, as submitted by learned counsel for the Petitioner, a formal order disposing of the said Demarcation Case by the Tahasildar, Kishorenagar should have been passed.

Accordingly, the writ petition is disposed of with a direction to Tahasildar, Kishorenagar-Opposite Party No.2 to dispose of Demarcation Case No.183 of 2019 as expeditiously as possible, preferably within a period of one month from the date of production of certified copy of this order, keeping in mind the report submitted by the Revenue Inspector, HandapaOpposite Party No.3, if there is no legal impediment. Issue urgent certified copy of the order on proper application.
