This interlocutory application has been filed by the petitioner for modification of order dated 31.03.2022 passed in CRLMP No.301 of 2022.

Heard Mr. S.K. Joshi, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel. 3.

Mr. Joshi submits that during course of hearing on 31.03.2022, Mr. Mohanty submitted that the I.I.C., Kantabanji P.S. has not put the shop room of the petitioner under lock and key and on the basis of that submission, the CRLMP was withdrawn but the said submission has not been reflected in that order. Mr. Mohanty fairly submits that on that date, he made such submission.

Considering the submissions made, this Court is of the view that the order dated 31.03.2022 passed in the CRLMP No.301 of 2022 ought to be recalled. This Court orders accordingly.

Since on instruction, Mr. Mohanty submits that the I.I.C., Kantabanji Police Station has not put the shop room of the petitioner under lock and key, Mr. Joshi wants to withdraw this application as he wants to approach the appropriate authority for redressal of the grievances of the petitioner. 3.

Considering the submissions made, this CRLMP is disposed of as withdrawn.
