The Petitioner has filed this writ petition praying for a direction to the opposite party to verify the original documents of the vehicle bearing registration number OD-15-1295 and accept the tax and grant fitness and permit certificate. So far as penalty is concerned, the Petitioner shall approach the appropriate authority under the O.M.V.T. Act. 3.
Heard learned counsel for the Parties.

It appears that the vehicle of the Petitioner has been seized for non-payment of tax and penalty as well as plying the vehicle violating the provision of the Motor Vehicles Act. The Petitioner now seeks release of the vehicle on payment of 50% of the outstanding amount. Since the Petitioner was plying the vehicle violating the provision of the Motor Vehicles Act, so
// 2 // also allegedly guilty of non-payment of tax and penalty, this Court is not inclined to entertain this writ petition. 5.
However, liberty is given to the Petitioner to make an application before the R.T.O., Jharsuguda ventilating his grievance in this regard. If such an application is filed, the R.T.O. concerned shall pass necessary order on the same not later than one month from the date of filing of such representation along with a certified copy of the order and intimate the decision to the Petitioner on the same. 6.
With the aforesaid order, this writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
