Heard Ms. I. Tripathy on behalf of Mr. B.K. Sharma, learned counsel for the Appellant.

The suit was for injunction and recovery of possession. The present Appellant is Defendant No.1. The case of Plaintiff is that he purchased the suit land in the year 1972 through oral sale and had filed an earlier suit against Defendant No.2 which was ended in compromise in 2002 and the decree was passed based on the compromise petition. The case of Defendant No.1 is that he subsequently purchased the suit land from Defendant No.2. The suit was allowed in favour of the Plaintiff which was confirmed by the 1st Appellate Court.

Upon hearing learned counsel for the Appellant, I do not find any substantial question of law in the present appeal. 4.
The appeal is dismissed.
