CORAM:

JUSTICE S.K. SAHOO Order No.

ORDER

05.08.2022 I.A. No. 1000 of 2022 04.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for extension of the date of surrender of the petitioner in the learned Court below. Learned counsel for the petitioner submits that the petitioner could not surrender before the learned trial Court as per the order dated 12.07.2022 passed in I.A. No.817 of 2022 due to strike and therefore, the date of surrender may be extended.

While rejecting the prayer of the petitioner for grant of anticipatory bail as per order dated 16.03.2022, directed the petitioner to surrender within four weeks from that date and move for bail.

Thereafter, the petitioner moved I.A. No.817 of 2022

// 2 // for extension of the date of surrender as he could not surrender within the aforesaid stipulated date due to his illness and this Court by order dated 12.07.2022 extended the date of surrender till 30th July 2022 and in the said order it has been clearly mentioned that no further extension of the date of surrender shall be granted.

Considering the averments taken in the interim application and the submission made by the learned counsel for the petitioner, the date of surrender of the petitioner as fixed as per order dated 12.07.2022 is extended till 31st August 2022. The rest part of the orders dated 16.03.2022 & 12.07.2022 remain unaltered. It is made clear that no further extension of date of surrender shall be granted.

I.A. is accordingly disposed of.

Issue urgent certified copy as per Rules.
