Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 03.02.2022 in connection with Malkangiri P.S. Case No.246 of 2020 corresponding to T.R. Case No.68 of 2020 pending in the Court of learned Sessions Judge-cum-Special Judge, Malkangiri.

A vehicle containing 80 kg of ganja was detained by the staff of Malkangiri Police in which two persons were occupants. On verification of the documents of the vehicle it came to light that the petitioner is the registered owner of the vehicle. The petitioner has been implicated on the ground of being the registered owner of the vehicle in which the contraband was being transported. There is no material to show that anything was seized from his exclusive and conscious possession.

Considering the above facts which do not reveal a prima face case against the petitioner, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and

conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
