This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Orkel P.S. Case No. 41 of 2020 corresponding to T.R. Case No.27 of 2020 pending in the Court of learned Adhoc Addl. Sessions Judge (FTSC), Malkangiri for offences punishable under sections 363, 376(3), 376(2)(n) of the Indian Penal Code and section 6 of the POCSO Act.

The petitioner moved an application for bail before the Court of learned Adhoc Addl. Sessions Judge (FTSC), Malkangiri, which was rejected on 04.02.2022.

// 2 // Perused the status report dated 14.09.2022 of the learned trial Court from which it appears that the petitioner has not surrendered before the learned trial Court as per the interim bail order dated 15.07.2022 passed in I.A. No. 1227 of 2022.

In view of the aforesaid report, since the petitioner has flouted the terms and conditions of the interim bail order, I am not inclined to grant bail to the petitioner. The prayer for bail stands rejected.

BLAPL is accordingly dismissed.
