Petitioner No.1, Private Company and its Order No.

Directors (Petitioner Nos.2 to 4) by filing the present writ petition have laid challenge to the Memo dated 31.01.2015 (Annexure-2) and 21.12.2015 (Annexure5), whereby their names have been proposed to be included in the list of willful defaulters as per the RBI guidelines for fraudulently diverting the amounts of funds/loans raised to other users/Companies for which they were not availed.

It is apparent that both the aforesaid impugned notices are not any orders whereby any decision has been taken instead are only informing

// 2 // the petitioners to make a representation against the proposal for inclusion of their names as willful defaulters and also informing them of the date of personal hearing fixed on 07.01.2016 at a notified venue for the first committee to take an appropriate decision upon the representation filed pursuant to Annexure-2.

At the time of hearing, learned counsel for the petitioners has filed a Memo dated 06.12.2022 in Court stating therein that the petitioners do not want to proceed further with the Writ Petition and prays for permission to withdraw the same. The Memo be kept on record.

In view of the Memo filed, the Writ Petition is dismissed as withdrawn.
