This matter is taken up through virtual/physical mode. 2.

The secured creditor/bank has filed the present writ petition seeking to quash the interim order dated 19th April, 2021 passed by the DRT, Cuttack in I.A. No.339 of 2021 arising out of S.A. No.97 of 2018 filed by the defaulting borrower challenging the recovery process initiated by the bank under Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 in a loan account declared NPA.

In view of the aforesaid order dated 19th April, 2021, whereby the DRT, Cuttack had restrained the bank from confirming the auction bid of the successful bidder, the bank is stated to have already moved an application for modification of that order.

The instant writ petition has been filed as the Presiding Officer of the DRT, Cuttack was not available. 5.

At the time of hearing, counsel for the Petitioner prays for permission to withdraw the present writ petition in view of the DRT, Cuttack being fully functional as of now.

Accordingly, this writ petition is dismissed as withdrawn.
