This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner undertakes to remove the defect in the course of the day.

Taking note of the lis which relates to a complain under Section 138 of the N.I. Act and keeping in view, the recent directive of the Apex Court regarding expeditious disposal of the case under the N.I. Act this Court calls upon the J.M.F.C. Bhubaneswar to conclude the trial in 1CC Case No.4026 of 2007 within a period of two months from the date of production of copy of this order. Taking note of the submissions of the learned counsel for the petitioner that the case is at the stage of hearing of arguments.

Because of the nature of relief prayed for, this Court is of the considered opinion that no notice need be issued to Opposite Party.

Since a person accused of an offence under Section 138 of N.I. Act cannot have a vested right in procrastination of trial. 6.

Accordingly, the CRLMC stands disposed of.
